Contract Description:
This contract will replace Contract 56662 REL 215 to cover YN Fisheries UCHRP staff costs, project overhead costs, and on-call service subcontract costs over the June 1, 2022 to May 31, 2023 performance period.  In addition, all BPA funded property inventory for the UCHRP will be reported under this contract.  This Contract includes the wages and overhead expenses of Yakama Nation staff working on accounting, budgeting, reporting, restoration project management, and subcontract management during the 1 year performance period.

The on-call subcontract work elements provided in this Contract allow the Yakama Nation to more efficiently conduct subcontracting for redundant yet critical site assessment, design, and post construction maintenance activities across our work region, increasing the efficiency to produce individual restoration projects that yield habitat mitigation credits for the Federal Columbia River Power System.  Topographic surveys, large wood haul, groundwater testing, native plant revegetation planning, and providing maintenance of vegetation and habitat structures on completed project sites are all restoration related activities that must be completed on all or most restoration project sites, yet these project elements are not the core restoration project elements that actually produce mitigation credits under the FCRPS BiOP.  Given the large number of projects Yakama Nation Fisheries is developing simultaneously, if the program were to break apart these redundant project support activities as separate work elements for each restoration project site, the Yakama Nation Accord contracts would be infinitely more complex and overloaded with redundant WEs and a confusion of related milestones and milestone dates, making it very hard to produce and review CRs and CCRs.  Also, this would likely require the Yakama Nation to request more CCRs more often as these critical yet redundant work elements become needed on individual projects at differing times in the project development and completion process.  Additionally, the Tribal contracting process would be overrun and dramatically slowed down by a need to constantly produce and modify subcontracts for redundant services with the same contractors on different work sites.  These effects would greatly impede the Yakama Nation's ability to produce the quantity of habitat restoration projects within the time frame of the Accords.

This "Staff and Subs" Contract will provide all needed support services for the YN Fisheries UCHRP to continue operations in the Upper Columbia Basin from June 1, 2022 to May 31, 2023.  Detailed work elements for implementation of specific restoration actions that are directly applicable to mitigation credits under the FCRPS BiOP are provided in separate Accord Contracts known as "Habitat Restoration Contracts".

*** Due to entity level constraints in transfering unallocated monies from FY 21 to FY 22 to fund this contract at the expected amount of $3,538,564, this scope of this CR 352816 has been reduced by $1.8 million to accomodate the June 1, 2022 contract start date.  It is anticipated that a CCR will be completed for this agreement to add back in FY 22 or FY 23 unallocated monies before December 2022 so that the 2022 and 2023 planned habitat restoration activities can continue uninterrupted.
